1. Acceptance of Terms

By registering for an AuctionBargain account, accessing the website, or using any AuctionBargain services, you agree to be bound by these Terms and Conditions. If you do not agree to these Terms, you must not create an account, place bids, list items, or otherwise use the AuctionBargain platform. AuctionBargain may update these Terms from time to time. Continued use of the platform after changes are posted constitutes acceptance of the updated Terms.

2. Eligibility and Account Responsibility

You must be at least 18 years old or the age of legal majority in your country of residence, whichever is higher, to register for an AuctionBargain account. By creating an account, you confirm that you meet this age requirement.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate, current, and complete information during registration and keep your account information up to date.

AuctionBargain may suspend, restrict, or close accounts for non-payment, suspected fraud, abusive behaviour, policy breaches, auction manipulation, repeated invalid claims, or improper payment disputes, subject to applicable law.

3. Business and Company Users

Both individuals and businesses/companies may register as buyers on AuctionBargain. If you register, bid, or buy on behalf of a company, you confirm that you have the authority to act for and bind that company.

If you register, bid, or buy on behalf of a company, both the company and you as the authorised user are jointly responsible for complying with these Terms, all payment obligations, and all auction rules. The company and the authorised user may be held liable for any breach of these Terms.

4. Auction Rules and Bidding

All bids placed on AuctionBargain are legally binding offers to purchase the item at the bid amount. By registering for an account, you agree that each bid you place is a binding legal contract.

When you place the winning bid on an auction, you are obligated to complete the purchase at the winning bid amount plus any applicable buyer premiums, fees, taxes, and delivery charges shown on the listing or at checkout.

AuctionBargain reserves the right to cancel bids, suspend accounts, or remove listings where fraud, error, prohibited goods, or policy breaches are suspected.

Winning bids are binding once the auction closes and the buyer is confirmed as winner. Buyers must pay within the payment timeframe stated on the auction or checkout page.

5. AuctionBargain Marketplace Role

AuctionBargain is an online auction marketplace only. Unless a listing expressly states otherwise, AuctionBargain is not the seller, manufacturer, warehouse, shipper, or direct fulfiller of the goods listed on the platform. Goods are sold by third-party sellers using the AuctionBargain marketplace. AuctionBargain provides the platform, facilitates bidding and payment processing, and coordinates auction and order records. Third-party sellers remain responsible for the accuracy of their item descriptions, item condition, legal right to sell, fulfilment, shipping, delivery, collection, warranties, and any seller-specific after-sale support.

6. Payment Terms

Payment for winning bids must be made within the timeframe stated on the auction or checkout page. Orders may not be released to the seller for fulfilment until payment is confirmed.

Accepted payment methods may include credit/debit card, PayPal, Apple Pay, Google Pay, and any other payment methods enabled at checkout. Some payment methods may be unavailable depending on your location, device, payment provider, risk review, or listing type.

Payments are processed securely by third-party payment providers. AuctionBargain does not store your full card number, CVV/CVC code, bank login credentials, PayPal password, Apple Pay payment credentials, or Google Pay payment credentials.

Failed, reversed, or disputed payments may result in order cancellation, account suspension, or recovery action, subject to applicable law.

7. Buyer Responsibilities

Before placing a bid, you must carefully review the full listing — including the item description, condition notes, photos, fulfilment method (shipping, collection, pickup, or courier), any stated delivery timeframes, taxes, fees, buyer premiums, and any seller support or warranty options.

You are responsible for providing accurate contact and delivery information. You are responsible for any taxes, customs duties, import charges, courier clearance fees, or local government charges that apply to your purchase or delivery, unless the listing or checkout clearly states that these charges are included.

8. Third-Party Seller Responsibilities

Third-party sellers are responsible for item accuracy, condition, legal right to sell, shipping, delivery, collection, courier coordination, packaging, item handover, warranties, and seller-specific after-sale support unless a listing expressly states otherwise.

Sellers must provide accurate listing descriptions, photos, item condition, model numbers, included accessories, known defects, fulfilment terms, taxes and fees, and any seller support options.

Sellers must not list counterfeit, illegal, unsafe, stolen, restricted, recalled, or prohibited items. Sellers must comply with all applicable consumer, product safety, export/import, tax, and advertising laws.

Third-party sellers must provide identity, business, contact, payment, and item ownership/right-to-sell information as required by AuctionBargain before listing items or receiving payouts.

9. Refund, Return, and Cancellation Policy

AuctionBargain is an auction marketplace. Completed auction purchases are final. AuctionBargain does not provide change-of-mind refunds for completed auction purchases. By registering, you agree that bids are legally binding contracts and auction purchases are final. Narrow refund or reversal exceptions may apply only where a duplicate payment occurred, proven fraud or unauthorised payment is confirmed, the seller cannot fulfil the order, the listing was materially incorrect, the item is materially different from the listing, or where a refund or reversal is required by applicable law, card-network rules, PayPal Buyer Protection, payment-provider rules, or another binding requirement. 10. Prohibited Conduct

Fake bids, shill bidding, bid manipulation, or any attempt to artificially influence auction outcomes is strictly prohibited.

Fraud, chargeback abuse, abusive communication, harassment, account misuse, attempts to avoid payment, and attempts to manipulate auctions are prohibited.

Any violation may result in immediate account suspension, bid cancellation, listing removal, and reporting to relevant authorities.

11. Limitation of Liability

To the maximum extent permitted by law, AuctionBargain, Confidia Limited, and their related companies, subsidiaries, directors, officers, employees, agents, and operating partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the AuctionBargain platform, including but not limited to lost profits, lost data, or business interruption. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under applicable law.

12. Governing Law and Disputes

These Terms are governed by the laws of New South Wales, Australia. Any disputes arising from or relating to these Terms or your use of the AuctionBargain platform shall be handled by courts in New South Wales, Australia, unless mandatory consumer law in your jurisdiction provides otherwise.

13. Changes to Terms

AuctionBargain may update these Terms and Conditions from time to time. Material changes will be communicated through the website or by email. Your continued use of the platform after changes take effect constitutes acceptance of the revised Terms.
