Welcome to AuctionBargain.com, a next-generation e-commerce and auction marketplace operated by Confidia Limited, an Australian public company with affiliated entities in Australia, Thailand, New Zealand, Europe, and other regions.

 

These Terms of Use (“Terms”) govern your access to and interaction with our website, mobile applications, and related digital services (collectively, the “Platform”). By accessing or using AuctionBargain.com, you agree to comply with these Terms. If you do not agree, you must not use our Services.

 

These Terms of Use should be read together with our Terms & Conditions and Privacy Policy, which together outline the legal framework, user obligations, and data protection standards applicable to your use of AuctionBargain.com.

 


 

 

1. Our Role and Platform Overview

AuctionBargain.com is a global online marketplace and auction platform where independent merchants, buyers, and affiliates engage in commerce using trusted local and international payment options.

The platform is owned and operated by Confidia Limited, which provides the technology, payment infrastructure, compliance oversight, and marketing systems that enable the marketplace to operate securely and efficiently.

AuctionBargain.com and Confidia Limited act solely as the marketplace operator and payment platform provider. We do not own, hold, import, or fulfill any products listed on the site. All goods are listed, described, and shipped directly by independent third-party merchants, who are solely responsible for their own listings, pricing, delivery, and after-sales obligations.

Confidia manages payment processing, account settlements, and dispute facilitation, but does not act as a party to any sale or transaction between buyer and seller.


 

 

2. Acceptance of Terms

By accessing, browsing, creating an account, bidding, or purchasing through AuctionBargain.com, you confirm that you:

  • Have read, understood, and agree to be bound by these Terms of Use and the Terms & Conditions;

  • Are at least 18 years old (or the age of legal majority in your jurisdiction);

  • Have the legal authority to enter into binding agreements; and

  • Will use the Platform in accordance with applicable laws and regulations.

If you represent a business, you warrant that you are authorized to bind that business to these Terms.


 

 

3. Account Registration and Security

To use certain features, you must register an account with accurate and up-to-date information. You agree to:

  • Not share your account access with others without authorization;

  • Immediately notify us of any unauthorized use or security breach; and

AuctionBargain grants you a limited, non-exclusive, non-transferable license to access and use the Platform for lawful purposes consistent with these Terms.

You agree not to:

  • Use the Platform for any unlawful, deceptive, or fraudulent purpose;

  • Interfere with the integrity or performance of the Platform or its data;

  • Upload, transmit, or distribute viruses, malware, or harmful code;

  • Infringe any intellectual property or privacy rights of others;

  • Manipulate auctions, reviews, ratings, or payment processes; or

  • Copy, modify, or reverse engineer any part of the Platform.

Any misuse of the Platform may result in account termination and legal action.


 

 

5. Content Ownership and Intellectual Property

All content, software, design, graphics, trademarks, and logos on AuctionBargain.com are owned or licensed by Confidia Limited and protected by international intellectual property laws.

You may not copy, reproduce, distribute, or create derivative works from any part of the Platform without written consent from Confidia.

Sellers retain ownership of their product images, descriptions, and branding but grant AuctionBargain a non-exclusive, worldwide, royalty-free license to display and promote such content on the Platform and related media.


 

 

6. Merchant and Buyer Responsibilities

 

6.1 Merchants

Merchants using AuctionBargain.com must:

  • Ensure all product listings are accurate, lawful, and complete;

  • Maintain sufficient stock to fulfill accepted orders;

  • Comply with consumer, advertising, and tax laws; and

  • Provide clear refund and shipping policies.

Merchants are solely responsible for the quality, authenticity, and delivery of their goods.

 

6.2 Buyers

Buyers agree to:

  • Review product descriptions before purchase or bidding;

  • Pay for orders promptly using approved payment methods;

  • Provide accurate shipping details; and

  • Contact the seller directly for order or warranty questions.

AuctionBargain does not guarantee product performance, delivery timelines, or merchant behavior but provides mediation tools where necessary.


 

 

7. Payments and Fees

Payments on AuctionBargain.com are processed through Confidia’s secure, compliant payment infrastructure, which may include local options such as BPAY (Australia) and PromptPay QR (Thailand), or other trusted partners globally.

Confidia acts as a payment facilitator and does not hold customer funds beyond settlement processing requirements.

All transactions are subject to anti-money laundering (AML), know-your-customer (KYC), and fraud-prevention checks under applicable law.

Users are responsible for any fees, taxes, or bank charges incurred during payment or refund processing.


 

 

8. Dispute Resolution Between Users

AuctionBargain provides internal tools for reporting disputes, order issues, or policy violations. We may assist in mediating communications between buyers and sellers but do not guarantee resolution or compensation.

All final settlements, refunds, or exchanges are handled by the relevant merchant.

9. Platform Availability and Maintenance

AuctionBargain may, from time to time, conduct maintenance or updates that limit platform access. While we strive to minimize downtime, we cannot guarantee continuous or error-free service.

Confidia and AuctionBargain shall not be liable for interruptions, delays, or data loss resulting from maintenance, system upgrades, or unforeseen events.


 

 

10. Third-Party Services and Links

Our Platform may include links to third-party websites or services, including logistics, payment, or affiliate systems. These are provided for convenience only.

Confidia is not responsible for the content, practices, or security of any third-party site. Users are encouraged to review third-party terms and privacy policies before interacting with them.


 

 

11. Limitation of Liability

To the maximum extent permitted by law, Confidia, AuctionBargain, and their affiliates are not liable for:

  • Any indirect, incidental, or consequential damages;

  • Loss of profits, data, goodwill, or reputation;

  • Errors, omissions, or interruptions in platform access; or

  • Any dispute, product issue, or non-performance by independent merchants.

Our aggregate liability for any claim related to platform use shall not exceed AUD 100 or the amount paid in connection with the relevant transaction, whichever is lower.


 

 

12. Data Protection and Privacy

Your personal data is handled in accordance with our Privacy Policy, which complies with the Australian Privacy Act, EU GDPR, UK GDPR, and Thai PDPA.

By using AuctionBargain.com, you consent to our processing of your data as outlined in the Privacy Policy.


 

 

13. Termination of Access

Confidia may suspend, restrict, or terminate your account at its sole discretion, without notice, if you:

  • Violate these Terms or applicable law;

  • Engage in fraudulent or harmful conduct; or

  • Pose a security or reputational risk to the platform.

You may also close your account at any time by contacting support@auctionbargain.com. Upon termination, any remaining obligations under these Terms will survive as necessary.


 

 

14. Governing Law and Jurisdiction

These Terms of Use are governed by the laws of New South Wales, Australia, without regard to conflict-of-law principles.

You agree to submit to the exclusive jurisdiction of the courts of New South Wales, unless otherwise required by consumer protection law in your jurisdiction.


 

 

15. Updates and Modifications

Confidia reserves the right to amend these Terms of Use at any time. The latest version will always be published on AuctionBargain.com with an updated effective date.

Continued use of the Platform after changes signifies your acceptance of the revised Terms.
