These Terms & Conditions (“Terms”) govern your access to and use of our website, applications, services, tools, and features (collectively, the “Services”).

By accessing or using AuctionBargain.com, you agree to be bound by these Terms. If you do not agree, you may not access or use our Services.

These Terms & Conditions should be read in conjunction with our Terms of Use and Privacy Policy, which together form the legal framework governing your use of AuctionBargain.com.

Confidia oversees the operation, compliance, and technical infrastructure of AuctionBargain.com, while independent merchants and sellers manage their own listings, products, and transactions.

Auction Bargain (AuctionBargain.com) is operated by Confidia Limited as an online marketplace and payment platform. Confidia Limited does not own, manufacture, import, or hold title to any products listed on the platform. All products are offered, sold, and shipped directly by independent third-party merchants, who remain solely responsible for product quality, product descriptions, pricing, fulfilment, warranties, and compliance with applicable laws and regulations.

Confidia Limited has affiliated entities and operational support teams in Australia, Thailand, Hong Kong, New Zealand, Europe, and North America. Depending on your location and the services used, the relevant Confidia Group entity may act as the data controller, operator, or processor as required by local laws.

2. Acceptance of Terms

By using AuctionBargain.com, creating an account, or participating in any transaction, you confirm that you:

Have read, understood, and agree to be bound by these Terms & Conditions, our Terms of Use, and Privacy Policy.
Are of legal age and have the capacity to enter into a binding agreement in your jurisdiction.

4. Accounts and User Obligations

Confidia does not own, store, or ship any goods and assumes no liability for product quality, authenticity, safety, or performance. All warranties, claims, and representations regarding products are the sole responsibility of the seller.

6. Payments and Processing

Payments made through AuctionBargain.com are processed via Confidia’s authorized financial partners. Supported local methods include BPAY (Australia), PromptPay (Thailand), and other secure global options.

AuctionBargain does not store complete card or payment instrument data. Payments are processed under international security and compliance standards, including PCI DSS and AML/KYC frameworks.

Any applicable service fees, commissions, or currency conversion charges will be disclosed before checkout or transaction completion.

7. Shipping and Delivery

Shipping and delivery are managed directly by sellers or their nominated logistics providers. Estimated delivery dates are for reference only and may vary by destination and courier.

Buyers must ensure that shipping information is correct at checkout. AuctionBargain and Confidia are not responsible for delays, losses, or additional costs due to incorrect addresses, customs procedures, or carrier errors.

Customs duties, taxes, or import charges (where applicable) are the responsibility of the buyer.

8. Refunds and Returns

Each seller sets their own return and refund policy, provided it complies with consumer protection laws.

If no specific policy is stated, the following general rules apply:

Refunds may be requested for defective, incorrect, or damaged goods within 14 days of receipt.
Returns must be sent in their original condition and packaging.
Refunds are processed through the original payment method when possible.
Some items (e.g., digital, custom-made, or perishable goods) may be exempt from return unless defective.

AuctionBargain may assist in dispute mediation, but does not guarantee outcomes or refunds.

9. Prohibited Conduct

You may not reproduce, distribute, modify, or create derivative works without written consent.

Sellers retain ownership of their product images and descriptions but grant AuctionBargain a non-exclusive, royalty-free, global license to use such content for promotion and platform display.

11. Limitation of Liability

To the fullest extent permitted by law:

Confidia, AuctionBargain, and their affiliates are not liable for indirect, incidental, or consequential damages resulting from your use of the platform.
We make no warranties regarding accuracy, completeness, availability, or merchant performance.
Our total liability for any claim shall not exceed the lower of AUD 100 or the total fees paid for the specific transaction involved.

These limitations apply even if we have been advised of potential damages.

12. Data Protection and Privacy

We process your personal data in accordance with our Privacy Policy, which outlines how information is collected, used, shared, and protected in compliance with the GDPR, UK GDPR, and Thai PDPA.

By using our Services, you consent to such processing.

13. Suspension and Termination

We may suspend or terminate your account without prior notice if we reasonably believe you have violated these Terms, applicable laws, or risk the integrity or security of the platform.

Upon termination, all rights and licenses granted to you under these Terms will cease immediately.

Confidia may also bring action in the jurisdiction where a user resides, if necessary to enforce rights or judgments.
